EPA’s Aerosol Can Universal Waste Rule

In late 2019, EPA announced the signing of its final Aerosol Can Rule. The final Rule adds hazardous waste aerosol cans to the list of universal wastes regulated under 40 CFR part 273. The universal waste regulations encompass protective requirements for facilities generating, handling, and transporting certain categories of hazardous waste that are commonly generated by a wide variety of establishments. It incorporates flexibilities, such as additional time to accumulate these wastes. By providing a clear, practical system for handling discarded aerosol cans, this change will reduce the regulatory costs for a wide variety of establishments generating and managing aerosol cans, including the retail sector. The streamlined standards are also expected to promote the collection and recycling of aerosol cans.
