To: Manufacturers, Distributors/Wholesalers, and Importers of Mercury-added Products

Subject: 2007 Triennial Reporting Requirements - Forms Due by April 1, 2008

This memo serves as a reminder to all mercury-added product reporting companies that the deadline for submission of 2007 Triennial Notification Forms is April 1, 2008. ALL filing companies and trade associations must complete a Form, regardless of the date of their last submission. Please download the most recent Forms and Instructions (December 2007 versions) here: http://www.newmoa.org/prevention/mercury/imerc/notificationforms.cfm. PLEASE NOTE the special instructions below for manufacturers of lamps, luminaires, and automobiles. You can submit your Forms to IMERC to comply with the notification requirements in all of the relevant states.

Since the 2004 Triennial Notification period, a number of IMERC-member states have initiated phase-outs and bans of certain mercury-added products, including switches and relays and measuring devices. Most recently Louisiana, New Hampshire, and Minnesota have passed legislation concerning mercury-added products. For Lamp Manufacturers:
After the 2004 Triennial reporting period, IMERC developed a specialized Notification Form specifically for use by manufacturers of lamp products. Recent filers have been notified of the new Form; however, many lamp manufacturers who last reported in 2005 may be unfamiliar with the new format. You can find the new Form for Lamp Manufacturers Only and Instructions at: http://www.newmoa.org/prevention/mercury/imerc/notificationforms.cfm.

For Luminaire Manufacturers:
Manufacturers of larger products are no longer allowed to refer to the component manufacturer for mercury use data and information. As a result, when submitting the 2007 Triennial Notification Forms, luminaire manufacturers must provide data on the range of mercury in bulbs sold in its luminaire products as well as the total mercury use for U.S. sales for all luminaire products shipped with installed bulbs.

For Automobile Manufacturers:
IMERC has developed a specialized Form to be used by the automobile manufacturers for the reporting of total mercury use by mercury-added component in vehicles sold during the 2007 calendar year. This is a separate Form from the Notification and Labeling Annual Update for Automobile Manufacturers that were recently filed. This new "Total Mercury Form for Auto Manufacturers Only" is now available for download at: http://www.newmoa.org/prevention/mercury/imerc/notificationforms.cfm.
