New York Environmental Leaders Program

Project Description The New York State Dept. of Environmental Conservation (NYS DEC), as directed by the draft Commissioner's Policy on Environmental Management Systems (EMS), developed the New York Environmental Leaders Program (NYEL) to encourage EMSs. An EMS Policy was signed by Commissioner Crotty on April 5, 2004. The Commissioner's Policy requires Department programs to promote EMSs that consider the following: views of stakeholders, measurable performance, credibility, and public disclosure and communication.

A meeting was held with the NY members of the EPA's Performance Track program June 8, 2004, to get stakeholder input on the design of this program. In addition to the Performance Track members, staff from the Department and EPA were among the 30 attendees. Staff conducted a survey that was used to gather input from stakeholders. The results of this survey were used to help develop an agenda for stakeholder meetings that were held in Albany, Rochester, and New York City.

The NYEL final policy was endorsed by Commissioner Sheehan on December 26, 2006 and took effect on January 26, 2007. NYS DEC Staff is currently taking the initial steps necessary to develop application material for the program. The Commissioner Policy on NYEL sets forth program requirements, benefits to participating organizations, and the responsibilities of the Department in implementing this program. The Department is implementing NYEL to provide recognition and incentives for those organizations that can demonstrate the use of pollution prevention practices, beyond compliance performance, or sustainable business practices as a result of their participation in NYEL. NYEL provides organizations with incentives to sustain their existing high levels of performance, and to motivate and enable organizations that are committed to reaching higher levels of performance.

The NYEL program recognizes and provides incentives to those organizations that can demonstrate the use of pollution prevention practices, beyond compliance performance, or sustainable business practices. The program has a five year entry tier and a three year leadership tier that can be renewed. Applicants to the leadership tier must have an Environmental Management System (EMS) in place. Incentives include recognition and assistance for both tiers and use of the NYEL logo, an exclusive awards category in the Environmental Excellence Awards program, a specific Department contact, and a coordinated schedule and scope of routine inspections as additional incentives for the leadership tier. The Program is targeting application submission dates for the first year for May 31, 2008 (for existing Performance Track) and August 31, 2008 (for all perspective members).

NYS DEC is currently in the process of transitioning existing members of EPA's National Environmental Performance Track (NEPT) into NYEL. Applications have been received from 14 NEPT members, and the NYS DEC is in the process of reviewing these applications. An open enrollment period for all prospective members will begin in September 2008.
